On April 2, 2021, Leah Jayde died in the bathtub by herself after her father Daniel James Gallagher, 26, forgot to turn off the faucets.
Leah’s death occurred just a few days after a near-tragic incident in which Gallagher left her unattended in 10 to 12 centimeters of water at their Queensland, Australia, home, according to The Sun.
After pleading guilty to Leah’s manslaughter, Gallagher has now been given a five-year sentence that will be suspended after 15 months.
According to testimony given in the Brisbane Supreme Court, Gallagher initially left Leah to take care of an electrical problem at the house.
But after going outdoors, he lit up a cigarette and spent some time scrolling through Facebook.
Leah was unconscious and “floating face down” in an overflowing tub when he went back to the bathroom.
While he awaited the arrival of the paramedics, Gallagher dialed 911 and attempted CPR.
At Hervey Bay Hospital, the child was declared dead after being transported there.
According to remarks from the crown prosecutor Chris Cook, Leah Gallagher’s death was “not an accident” even though the father expressed regret for leaving her alone for almost seven minutes.
Mr Cook said in court: “It was beyond reckless. This was more than inattention, his actions caused an entirely avoidable death.
“The victim impact here is of course extreme.”
Gallagher and the child’s mother, Shaylan, had separated in 2020 and the court heard how a similar incident days earlier had ended in a narrow escape while Leah was in her dad’s care.
When Shaylan arrived at the house that time, Gallagher was apparently smoking and Leah was supposedly alone in the bathroom.
Leah was declared unconscious over the phone, and Shaylan reported to ABC that she immediately started “screaming and sobbing her eyes out.”
